View the Space, Inc. (including its subsidiaries View the Space Ltd. and VTS Lane, Inc., collectively referred to as “VTS,” “we,” or “our”) is committed to protecting your privacy.

This Privacy Policy explains what information we collect, how we use it, and the choices you have when interacting with us. It applies to information collected through the websites operated by VTS (our “Websites”) and the VTS, Rise, and Activate platforms (collectively, the “VTS Properties”), as well as communications with us via email, text, or other electronic means.

This policy does not cover information collected through offline interactions.

Please read this Privacy Policy carefully to understand our practices regarding your information and how we will treat it. By accessing or using any VTS Properties, you agree to the terms of this policy.

If you are a resident of (A) California or (B) the EU, UK, or Switzerland, you may have additional rights described in Sections VI, VII, and VIII below, as applicable.

DATA WE COLLECT, HOW WE COLLECT IT, AND HOW WE USE IT

We collect the following information about you, either because you provide it to us, it is directly necessary to provide our services, or because it helps us improve the Websites and VTS Properties. If you are from Europe, please visit Appendix I for a breakdown of the General Data Protection Regulation (“GDPR”) legal bases under which we use your information.

    1. Information You Disclose To Us. We collect information that you voluntarily provide to us when you register with the VTS Properties, participate in activities on the VTS Properties or Websites, when you purchase or engage in VTS services, when you upload content to the VTS Properties, or when you otherwise contact us. This information includes the following types of personal information and is used for the purposes described below:
      1. Identifiers: Information by which you may be personally identified, such as your name, postal address, e-mail address, and telephone number. 
        1. Purpose of Use: We use this information to verify your identity, provide you with the services and products you request, send you notices about your account, notify you about changes to the VTS Properties, allow you to participate in interactive features, respond to your inquiries, and fulfill contractual obligations including billing and collection.
      2. Geolocation Data: Information about the physical location of you or your device. 
        1. Purpose of Use: To enable access control integrations as available within VTS Properties. Before any such data is collected, you will be prompted to permit or deny collection of geolocation data for use of such location-based services. We do not store location data beyond the last used location or use it for any other purposes.
      3. Commercial Information:  Information about commercial transactions made through the VTS Properties, such as transaction history or amenity reservation information.  
        1. Purpose of Use: We use this information to provide the services you request, fulfill contractual obligations, and to improve the VTS Properties.
    2. Information Automatically Collected. We automatically collect, ourselves or through third party providers, the following types of personal information when you visit, use or navigate the VTS Properties. For clarity, both  categories of information described are considered Internet or Electronic Network Activity Information
      1. Log and Usage Data. This includes usage details, page views, traffic data, location data (as described above), logs, other communication data and the data regarding the resources that you access and use on the VTS Properties, and information about your computer and internet connection, including your IP address, operating system and browser type. 
        1. How We Collect It: We collect this information from your  browser and device through server logs and analytics tools when you interact with the Websites and VTS Properties.
        2. Purpose of Use: We use this information to maintain and improve the VTS Properties, customize elements to your interests, speed up searches, recognize you when you return, and ensure security.
      2. Cookies and other Tracking Technologies. We, including through third providers, use “cookies” and similar technologies to collect information such as your IP addresses, internet service provider, browser type, operating system and language, referring and exit pages and URLs, date and time, amount of time spent on particular pages, what sections of the Site you visit, number of links clicked, search terms and other usage data.
        1. How We Collect It: We collect this information when you interact with VTS Properties through cookies and similar technologies placed by us and by third-party providers, including advertising and analytics partners, which may track your online activities over time and across different websites (subject to your rights under Section III).
        2. Purpose of Use: We use this information to improve the VTS Properties, enhance your overall experience by analyzing usage patterns to optimize site performance, customize content and features based on your preferences, and delivering relevant marketing or promotional messages that align with your activity and interests.

HOW AND WHEN WE SHARE YOUR INFORMATION WITH THIRD PARTIES

We disclose your personal information with the following categories of third parties for the purposes described below. If you are a California resident, please visit Appendix I for a more detailed breakdown of how we disclose and share your information.

    1. Vendors, consultants, and service providers. 
      1. We disclose your information to third party service providers who assist us with direct marketing, data storage, hosting, analytics, disaster recovery, sales support, and other business operational purposes and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them;
    2. With other users of the VTS Properties.
      1. As a user, you may have the ability to access to third party services and web pages. When interacting with those services and pages, your information will be shared with those third parties based on that interaction. For example, if you use a third party processor to pay for an amenity reservation, the information you enter into the payment form will be shared with that processor, subject to the processor’s terms and privacy policy.
  • We reserve the right to share your personal information in the future, subject to the terms of this policy, as follows:
    1. With government authorities, law enforcement agencies, our affiliates and subsidiaries, or our legal counsel to comply with any court order, law, or legal process, including to respond to any valid government or regulatory request;
    2. To enforce or apply our terms of use and other agreements, including for billing and collection purposes;
    3. If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of VTS, our customers, or others; or
    4. To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of VTS’ assets.

YOUR PRIVACY CHOICES

  1. We do not sell your personal information. 
  2. Manage Cookie Preferences. To view or change your cookie settings, or to opt out of non-essential cookies, please visit Cookie Settings. 
  3. Do Not Track. We do not respond to “Do Not Track” settings or other related mechanisms at this time.

Exercising Your Privacy Rights; Questions or Concerns. You may contact us to exercise your privacy rights or to relay any questions or concerns as set forth in  Section IX.

DATA SECURITY

We use industry-standard technical and organizational measures to protect your personal information from loss, unauthorized access, use, alteration, or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. Your security also depends on you. If you have a password for access to our services, you are responsible for keeping it confidential and not sharing it with anyone. While we strive to protect your data, any transmission over the internet is at your own risk, and we are not responsible for circumvention of security measures on the VTS Properties.

DATA RETENTION  

 VTS may retain your personal information only for so long as we have a legitimate business purpose to use that information, but in no event longer than seven years from your last interaction with VTS.

CALIFORNIA AND ADDITIONAL U.S. STATE PRIVACY RIGHTS

Depending on your place of residence, you may have certain rights regarding how we collect, use, and share your personal information. If you are a resident of California, you have specific rights under the CCPA, enumerated below. Residents of other U.S. states may also have similar rights under applicable privacy laws. Please note: These rights may be subject to limitations or exceptions under applicable law, and not all rights may apply in every circumstance.

  1. The right to confirm whether we are processing your personal information, and to access it.
  2. The right to request we correct inaccuracies in your personal information.
  3. The right to request we delete your personal information.
  4. The right to request a copy of the personal information you provided to us.
  5. The right to opt out of processing of your personal information for targeted advertising purposes.
  6. The right to opt out of profiling and automated decision-making in furtherance of decisions that produce legal or similarly significant effects.
  7. The right to opt out of the sale or sharing of personal information.
  8. The right to designate an agent to submit a request on your behalf.
  9. The right to appeal a decision regarding your rights request.
  10. The right to limit the use and disclosure of sensitive personal information. 
  11. The right to receive equal service and price, even if you exercise your privacy rights.

EUROPEAN PRIVACY POLICY

    1. Data Controller Contact and Status. We act as the data controller for personal information collected through our websites, properties, and communications. This includes identifiers and contact details, commercial and reservation records, device and usage data (including cookies), geolocation (if enabled), and business contact information for demos, support, and marketing.

  1. Legal Bases for Processing Your Personal Information. Please visit Appendix I for a description of the legal bases for which we process your personal information. 
    1. Please note that when we process you personal information on the basis of your consent, you have the right to opt out of such processing at any time—such as when we collect or share your personal information through non-essential cookies.     2. Additionally, for processing done on the basis of contractual necessity, if you choose not to provide this information, we may be unable to create your account, process requests or transactions, or deliver the services you request, as applicable.
    3. VTS does not engage in automated decision making or profiling in connection with personal information.
  2. Your Privacy Rights.  If you are in the EU, Switzerland, or the UK, you have the right to: 
  1. Request a copy of the personal information we hold about you (including in a structured, commonly used, machine-readable format where applicable under the right of data portability),
  2. Request that we transmit your personal information to another controller (where applicable under the right of data portability),
  3. Request that we correct your data,
  4. Request that your data be deleted,
  5. Withdraw your consent, if you have consented to our use of personal information for a specific purpose,
  6. Request that your data be restricted, and
  7. Object to the processing of your personal information.

  • Contact Your Data Protection Authority.
  1. If you are in the EU and have a concern about our processing of personal information that we are not able to resolve, you have the right to lodge a complaint with the data protection authority where you reside.   1. International Transfers.   We may transfer your personal information outside the European Economic Area (EEA) to countries that do not provide the same level of data protection as the EEA. When we do so, we ensure that appropriate safeguards are in place to protect your information. When we transfer personal information to third-party service providers acting on our behalf, we do so under appropriate contracts and remain responsible for their processing of that data in violation of the Data Privacy Framework Principles, unless we prove we are not responsible for the event giving rise to the damage.

Specifically, VTS complies with the EU-U.S. Data Privacy Framework (DPF), the UK Extension, and the Swiss-U.S. DPF as set by the U.S. Department of Commerce and relies on such frameworks for  transfers to the United States. We have certified adherence to the DPF Principles for personal information received from the EU, UK, and Switzerland. If this policy conflicts with the DPF Principles, those Principles govern. You can view our certification at https://www.dataprivacyframework.gov. When we transfer personal information to third-party service providers acting on our behalf, we do so under appropriate contracts and remain responsible for their processing of that data in violation of the DPF, unless we prove we are not responsible for the event giving rise to the damage.

For questions or complaints about your personal information, contact us at privacy@vts.com or as set forth in Section IX. We will respond within 30 days. If unresolved, we cooperate with EU Data Protection Authorities, the UK ICO, and refer disputes to JAMS (https://www.jamsadr.com/DPF-Dispute-Resolution) at no cost to you. Under certain conditions, you may invoke binding arbitration through the DPF Panel.

CHILDREN

We do not knowingly collect personal information from children under 13. If you are under 13, do not provide us with personal information. Parents and guardians should monitor their children’s online activity and instruct them not to share personal information without permission. If you believe a child under 13 has provided us with personal information, please contact us as described in Section IX so we can delete it. We do not have actual knowledge of selling or sharing personal information of consumers under 16. If we become aware that we have collected or shared such information, we will promptly delete it.

CHANGES TO THIS POLICY

We may update this privacy notice from time to time. The updated version will be indicated by the “last updated” date at the top of the policy and will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. You are responsible for ensuring we have an up-to-date email address for you, and for periodically visiting our Websites and this privacy policy to check for any changes

  • Authorized Agent; Verification Process. If you are a resident of a jurisdiction that affords you the privacy rights detailed in Sections VI-VIII and you choose to use an authorized agent to exercise your rights, we may deny the request if the agent does not provide proof of valid authorization. To process any request, we must verify your identity by matching the information you provide with our records or by contacting you through a previously provided method. Any data collected for verification will be used solely for that purpose and deleted once verification is complete. In some cases, we may request additional information to confirm your identity and prevent fraud.
